By accessing or using FEND (“the Service,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

FEND is an AI-powered financial defense platform that helps users identify potential overcharges, billing errors, and negotiation opportunities in areas including bank fees, medical bills, contracts, credit reports, salary benchmarking, and probate guidance.

The Service provides informational and educational content only. FEND is not a law firm, financial advisor, tax advisor, or licensed professional services firm. Nothing in the Service constitutes legal, financial, tax, or professional advice.

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using FEND, you represent and warrant that you meet these requirements. The Service is intended for use by residents of the United States and United Kingdom. Use from other jurisdictions is at your own risk.

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activity that occurs under your account

We reserve the right to terminate accounts that violate these Terms or that have been inactive for more than 12 months, with reasonable notice.

FEND offers subscription plans (Starter, Guardian, Arsenal) and one-time purchases. All fees are stated in US dollars unless otherwise specified.

• Billing: Subscription fees are charged at the beginning of each billing period (monthly or annual)
• Cancellation: You may cancel at any time via your account settings. Cancellation takes effect at the end of the current billing period
• No refunds: Subscription fees are non-refundable except where required by applicable law. One-time purchases are non-refundable
• Price changes: We may change prices with 30 days’ notice. Continued use after notice constitutes acceptance

You agree not to use the Service to:

• Submit false, misleading, or fraudulent information
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to reverse-engineer, scrape, or copy the Service
• Use the Service for any commercial purpose other than your personal financial matters
• Transmit malware, viruses, or other harmful code
• Harass, threaten, or abuse other users or FEND staff

FEND uses artificial intelligence to generate analysis, letters, scripts, and other content. You acknowledge that:

• AI outputs may contain errors, inaccuracies, or omissions
• AI-generated content is for informational purposes only and does not constitute professional advice
• You are solely responsible for reviewing, verifying, and deciding whether to use any AI-generated content
• FEND makes no guarantee of any specific financial outcome, recovery amount, or result
• For matters involving significant legal, financial, or medical consequences, you should consult a licensed professional

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You consent to the collection and use of your data as described in our Privacy Policy.

The Service may integrate with third-party services (e.g., Plaid for bank connections, Stripe for payments). Your use of these integrations is subject to the applicable third-party terms and privacy policies. FEND is not responsible for the acts or omissions of third-party services.

All content, features, and functionality of the Service — including but not limited to text, graphics, AI models, software, and trademarks — are the exclusive property of FEND, Inc. and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

To the maximum extent permitted by law, FEND, Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising out of or in connection with your use of the Service.

Our total liability for any claim arising out of these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) $100 USD.

You agree to defend, indemnify, and hold harmless FEND, Inc. and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved by binding arbitration in accordance with the American Arbitration Association rules, on an individual basis. You waive the right to participate in class actions.

We may update these Terms at any time. Material changes will be communicated via email or prominent notice in the Service. Continued use after the effective date constitutes acceptance of the revised Terms.
